Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Packory's website (packory.app, console.packory.app), applications and services (together, the "Services"), operated by Packory, a Malaysian business registered under the Registration of Businesses Act 1956 ("Packory", "we", "us").

By creating an account or using the Services, you agree to these Terms. If you use the Services on behalf of a business, you represent that you are authorised to bind that business.

2. The Service

Packory lets merchants record verifiable evidence of their order-packing process and share proof with buyers or marketplaces. Core features include:

  • On-device / station recording of packing;
  • AWB/tracking scan and matching;
  • Hands-free capture flow with integrity metadata (timestamp, integrity hash, audit trail);
  • Upload of evidence videos to the merchant's own Google Drive;
  • Sharing of a verification/evidence link (e.g. via WhatsApp) to a buyer or platform.

3. Accounts & eligibility

  • You must be at least 18 years old and have authority to use the Services.
  • You are responsible for keeping your login credentials and connected accounts (including Google Drive) secure.
  • You must provide accurate information and keep it up to date.

4. Plans, fees & payment

  • Plans are based on a verified-order allowance per month (currently Free 25 / RM12.99 / RM39.99 / RM69.99 / RM149 tiers, as displayed on the website). A cap + overage may apply for usage beyond your allowance, charged at the rate shown on the website (currently RM0.19 per verified order, subject to change on notice).
  • "Founding member" promotional pricing may be locked for a stated period (e.g. 60-day beta) and is subject to the terms of that promotion.
  • Payments are processed by our third-party payment gateway (card). You authorise us to charge the payment method you provide, including recurring charges for the billing period you select.
  • Auto-renewal and cancellation. If you choose a subscription, it renews automatically at the end of each period (monthly or annual) at the price in force when you subscribed, until you cancel. You can cancel at any time from Billing in your dashboard: cancellation stops future charges and your access continues until the end of the period you have already paid for. Where a plan is offered as a one-time payment instead, no recurring charge is made and you renew when you choose.
  • We may change pricing or plans with reasonable notice. Changes apply to future billing periods.

5. Your Google Drive & your content

  • The Services require you to connect a Google Drive account. Packory uploads evidence videos into a folder on your Drive.
  • You own your content, including your packing videos and data.
  • You are responsible for:
  • the security of your Google account and Drive;
  • having sufficient Drive storage and a working internet connection for uploads;
  • maintaining backups of your evidence if you need them (we do not host your videos on our servers beyond temporary processing).
  • Revoking Google access may prevent new evidence from being uploaded or managed.

6. Your responsibilities & warranties

You agree and warrant that you will:

  • Only record packing content you are lawfully entitled to record;
  • Comply with all applicable laws, marketplace/platform rules (e.g. Shopee, Lazada, TikTok Shop, etc.) and the PDPA when collecting, recording and sharing personal data;
  • Obtain any necessary consent from individuals whose personal data appears in your recordings (e.g. names/addresses on parcels) where required by law;
  • Not use the Services to record illegal, dangerous or prohibited items/content, or content that infringes third-party rights;
  • Not attempt to manipulate, falsify or tamper with evidence or its integrity metadata;
  • Not misuse, resell or sublicense the Services except as permitted by these Terms.

7. Evidence & dispute outcomes, important disclaimer

  • Packory provides tools to capture and preserve evidence. We do not decide disputes, and we do not guarantee any outcome from a marketplace, bank, insurer, tribunal or court.
  • Evidence may help support a claim, but acceptance of evidence is at the discretion of the relevant platform or authority.
  • We do not warrant that recordings will be error-free (e.g. failed upload, device issue, storage disconnect). Where technically feasible we will help you recover or troubleshoot.

8. Acceptable use

You may not:

  • reverse engineer, copy or scrape the Services (except as allowed by law);
  • probe or attack our infrastructure;
  • use the Services for unlawful, deceptive or harmful activity;
  • interfere with other users' accounts or evidence.

9. Intellectual property

  • Packory owns all rights in the Services, website, branding and software. You receive a limited, non-exclusive, revocable right to use the Services under these Terms.
  • You retain all rights in your content. You grant us a limited licence to process, store and transmit your content solely to provide the Services to you.

10. Third-party services

The Services integrate with third parties, including Google (for the Google Drive you connect and website analytics), plus cloud infrastructure/hosting, email delivery and payment providers. These are governed by their own terms and privacy policies. We are not liable for their availability or acts.

11. Termination

  • You may stop using the Services and close your account at any time.
  • We may suspend or terminate access for breach of these Terms, non-payment, fraud risk, or where required by law.
  • On termination: your evidence videos in your own Google Drive remain yours. Access to the Packory console will end. Provisions that by nature survive termination (e.g. liability, indemnity, IP) continue.

12. Disclaimers & limitation of liability

  • THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. THIS DOES NOT AFFECT RIGHTS YOU HAVE UNDER LAW THAT CANNOT BE EXCLUDED.
  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACKORY'S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES (WHETHER IN CONTRACT, TORT OR OTHERWISE) IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA OR BUSINESS OPPORTUNITIES.

13. Indemnity

You agree to indemnify and hold Packory harmless from claims, losses and costs (including legal fees) arising from your content, your use of the Services, or your breach of these Terms or applicable law.

14. Governing law & disputes

These Terms are governed by the laws of Malaysia. Disputes shall first be attempted in good faith between the parties; failing resolution, either party may refer the dispute to the courts of Malaysia.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date, and where practical we will notify account holders. Continued use after changes constitutes acceptance.
